Refund, Cancellation & Rescheduling Policy

This Refund, Cancellation & Rescheduling Policy applies to all bookings made with Yachts4U (www.www.yachts4u.com.au) for private charters, cruises and related services.
1. Payments and bookings
All bookings are subject to availability and are confirmed once the required payment or deposit has been received.
Payments made for confirmed bookings are non-refundable for customer cancellations, change of mind, failure to attend, late arrival or other circumstances unrelated to a failure by Yachts4U to provide the booked service, subject always to the customer’s rights under the Australian Consumer Law.
2. Customer cancellations
If a customer chooses to cancel a confirmed booking, the payment is generally non-refundable.
Where appropriate and at our discretion, we may offer the customer the opportunity to reschedule the booking rather than forfeit it.
Any rescheduling request must normally be made at least 6 hours before the originally scheduled booking time.
Rescheduling is subject to vessel, crew and operational availability.
3. Weather conditions
Charters operate on Port Phillip Bay and are therefore subject to weather and marine conditions.
Rain, cloud, wind or other weather conditions do not automatically make a charter unsafe or entitle the customer to a refund.
The Master of the vessel has final authority to determine whether conditions are safe for operation.
If conditions are considered safe but may be less comfortable than expected, customers may be offered, at our discretion, the option to:

• proceed with the charter as booked;
• reschedule the charter to another available date; or
• accept another alternative arrangement offered by Yachts4U.

Where a booking is rescheduled because of adverse weather, the rescheduled charter will be provided at no additional charge, subject to availability.
If the Master determines that conditions are unsafe and the charter cannot reasonably proceed, Yachts4U will offer an appropriate rescheduling option or other remedy consistent with the Australian Consumer Law.
4. Rescheduled bookings
Where a customer agrees to reschedule a booking, the original payment will be transferred to the new booking.
A rescheduled booking does not automatically become refundable merely because the customer later decides not to proceed with the replacement date.
The customer should contact us to arrange a mutually suitable replacement date, subject to availability.
5. Late arrival and no-show
Customers should arrive at the agreed pickup location on time.
If a customer arrives late, the charter may still finish at the originally scheduled finishing time.
If a customer fails to attend the booking without prior agreement, the booking may be treated as a no-show and the payment may be forfeited.
6. Cancellation by Yachts4U
If Yachts4U cancels a charter because of vessel unavailability, mechanical problems, safety concerns or another matter within our responsibility, we will offer the customer an appropriate remedy, which may include rescheduling or a refund, having regard to the circumstances and the Australian Consumer Law.
7. Safety
The Master has overriding authority in relation to the safety of the vessel, passengers and crew.
The Master may delay, modify, shorten, relocate, reschedule or cancel a charter where reasonably necessary for safety, weather, marine traffic, operational or regulatory reasons.
8. Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
